if you patch the games you console will be flagged to be banned and your right some games force you to update. This another attempt by M$ to get rid of modified firmware on xbox live.
update: I patched it to wave 3 and it still did not boot.

It will be called LT+ and and the ap2.5 checks will be catered for, but it would be even more dangerous to go on live i would suspect.
