Can your system get banned for using one? And are there any updated HDD hacks/flashes that let you make one with any make/model HDD?

Yes you can get banned for using modified HDD's on Xbox LIVE.. Though i must admit i haven't heard any HQ members mention they have been banned for upgrading their hdd's.

HDDHackr is currently the only tool which supports upgrading xbox 360 hdd's. You can learn more about it in our homebrew area here:

Yup pretty much what ForAHobby said, except the HDD Upgrade hack literally changes the firmware in the Hard Drive, so the chances of being caught are at least 1/5000, in other words, the chances of being caught are so low I can't even describe it.
