Well the person I talked to on the phone ssid I was getting a new console not a refurb. So I am going to try my hardest to get a new one. I think they owe me that at leats after all this

Yeah they said there wasnt a new one at the service center and they only send new consoles out when they are available. I told them that this one I just got in the mail makes a funny noise like something is loose when you play a game or movie and I was told that I would probaly have to send it back. So not only did I not get a new one but the one I got sounds like something is inside the DVD drive

Well okay do you have the name of the person you talked to at Microsoft CSC that told you that they were sending you a new system? Call the CSC and if you have the name tell them that so and so promised you a brand spanking new system. If you didn't write down the name then you are going to have to go through the process all over again. But the least they should do is send you a brand new system and not a refurb. Make them do it! You can make them send you a new system by calling them and start by telling them immediately that you need to talk to a supervisor. Then explain the situation again and if they say they cant send you a new system like you were promised that not only are you filing another complaint with the BBB but you are going to retain legal counsel on this matter and also tell them that any lawyer would give their left arm to take this case on. It is obviously a blatant breach of a verbal contract between you and Microsoft. I am going to talk to my friend who is a lawyer and see what he advises you do. Alot of lawyers will take on a case with no money down and take a large chunk of the money made in any settlement. So anyhow try the above and like I said I will talk to a lawyer friend of mine and see what he says. _________________________________________________________

Well I reopened my BBB complaint against them that was the only way to get someone to call me. I am going to use this console until I get this resolved. CSC basically told me that a refurb is the same as a new console because the only thing that is used it the case, but I highly doubt that
If it was a brand new console inside that means it has the new chipset and shouldn't get as hot. Also the new chipset runs on a new power supply.Did you get a new power supply with it? Does it run hot? _________________________________________________________
No refurbs come with the new chipset rebel, they all have the old chipset still (that is until the falcons start breaking more often). _________________________________________________________
